Fantasy Sports and Gaming Corporation

1. Acceptance of Terms

By accessing and using the Fantasy+ app (the “Service”), operated by Fantasy Sports and Gaming Corporation, a Florida Corporation (“Fantasy+”, “we,” “us,” or “our”), you (“you,” “user,” or “player”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Service. Your continued use of the Service constitutes acceptance of these Terms.

2. Description of Service

Fantasy+ provides a platform for users to participate in skill-based free-to-play fantasy football competitions, including both fantasy team management and picks divisions. The Service allows users to create and manage virtual football teams and make player stat outcome predictions, competing against other users for the bragging rights of topping the leaderboard and the opportunity to win nominal prizes based on their skill and knowledge, as outlined in the Rulebook provided in the app.

3. Eligibility

The App is not intended for use by children under the age of 13. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under the age of 13, please do not use the App.
3.1. Compliance with COPPA and Other Laws: Fantasy+ is committed to complying with the Children’s Online Privacy Protection Act (COPPA) and other applicable privacy laws that provide enhanced protections for children’s data. As a result, we do not knowingly collect or solicit personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us with personal information, please contact us at support@fantasyplus.com.
3.2. Employees of Fantasy Sports and Gaming Corporation and their immediate family members are eligible to play but not receive prizes. In the event an employee or their immediate family member wins a weekly or season-long contest, the prize will go to the second-place user.

4. Account Registration and Security

To use the App, you must create an account by providing a verifiable phone number. Access to the App is granted by entering a 6-digit code sent to your provided phone number. You are responsible for ensuring that the phone number you provide is accurate and up to date. You acknowledge that standard text messaging and data rates may apply when receiving codes or other communications from us.

5. User Conduct

You agree not to:
  • Use the Service for any illegal or unauthorized purpose.
  • Impersonate any person or entity.
  • Transmit any viruses, malware, or other harmful code.
  • Interfere with or disrupt the Service or servers.
  • Attempt to gain unauthorized access to any portion of the Service.
  • Engage in any form of cheating or collusion.
  • Post or transmit any content that is offensive, discriminatory, or violates the rights of others.
  • Use any automated system, including “bots,” “spiders,” or “offline readers,” to access the Service.
  • Attempt to manipulate contest results or scores.

6. Contests and Prizes

  • The Service offers free-to-play fantasy football competitions.
  • Our free-to-play contests feature weekly, and season-long leaderboard rankings determined by the specific rules within the app. We may award nominal prizes as outlined in the rulebook and at our sole discretion.
  • Fantasy Sports and Gaming Corporation has the right to modify or cancel contests at any time.

6. Prizes and Winners

The Fantasy+ App may offer weekly and season-long prizes to the winners of our skill-based fantasy team management and picks divisions, subject to the specific rules and eligibility criteria outlined in our separate Rulebook, which is incorporated into these Terms by reference. Participation in these contests is free; no purchase, entry fee, or other form of consideration is required to be eligible for prizes.
By participating in the Fantasy+ competitions, users acknowledge and agree that the outcomes are determined by the application of skill, knowledge of football, and strategic decision-making, not by chance.
Winners are determined according to the rules of each competition as detailed in the Rulebook. By participating in these contests, you agree to abide by these rules.
Prizes will be nominal in value and may include, but are not limited to, discounts to sponsor stores, discounted subscriptions to sponsor services, or gift cards. Prizes will typically be communicated and distributed via SMS text message to the verifiable phone number used to create your account.
Fantasy+ reserves the right to modify or discontinue the offering of prizes at any time, with or without notice, and the specific prizes awarded are subject to change. Eligibility for prizes may be subject to additional requirements as outlined in the Rulebook. Fantasy+ is not responsible for any issues related to the redemption or use of prizes provided by sponsors.

7. Payment and Refunds

  • The Service is free to play, and there are no entry fees.

  • There are no refunds.

8. Intellectual Property

All content, features, and functionality on the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, are the exclusive property of Fantasy Sports and Gaming Corporation or its licensors and are protected by intellectual property laws.
8.1. Licensed Content: The App may include content that is licensed from third parties, including but not limited to NFL logos, team names, and player images (“Licensed Content”). This Licensed Content is the intellectual property of the respective third-party owners and is used by Fantasy Sports and Gaming Corporation under license. You acknowledge that you do not acquire any ownership rights in the Licensed Content by using the App.
8.2. User Restrictions: You are granted a limited, non-exclusive, non-transferable license to access and use the App and the content provided therein for your personal, non-commercial use only. You agree not to copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the App, including the Licensed Content, without the express prior written consent of Fantasy Sports and Gaming Corporation or the respective third-party owner.
8.3. Trademarks: All trademarks, service marks, logos, and trade names appearing on the App, whether registered or unregistered, are the property of Fantasy Sports and Gaming Corporation or their respective owners. The use of any of these marks without the prior written consent of Fantasy Sports and Gaming Corporation or the respective owners is strictly prohibited.

9. Disclaimer of Warranties

  • The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • We do not warrant the accuracy or reliability of any content or information provided on the Service.
  • We are not responsible for any errors or omissions in the scoring or statistics used in contests.

10. Limitation of Liability

  • In no event shall Fantasy Sports and Gaming Corporation be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
  • Our total liability to you for any claim arising out of or relating to these Terms or the Service shall be $0.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fantasy Sports and Gaming Corporation and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys’ fees) arising out of or in connection with your use of the Service or your breach of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Service or by other means. Your continued use of the Service after the changes constitute your acceptance of the updated Terms.  

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal disputes arising out of or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Florida.

14. Termination

You may delete your account at any time through the App’s settings. Upon deletion, all user data will be permanently removed from our servers, except as required by law. Fantasy Sports and Gaming Corporation reserves the right to update, manipulate, suspend, or terminate any account at any time, for any reason, without notice. Upon termination, your rights to use the App will immediately cease.

15. Third-Party Services and APIs

The App may integrate with third-party services or APIs necessary to operate the game. Fantasy Sports and Gaming Corporation is not responsible for the content, accuracy, or performance of third-party services. Your use of third-party services is governed by the terms and conditions of the respective third-party providers.

17. Specific Sport Rules

The specific rules and scoring for Fantasy Football will be available within the app.

18. Advertising and Promotions

The Service may display advertisements and promotional materials from sponsors. By using the Fantasy+ App, you acknowledge and agree that you may be exposed to such advertising. We are not responsible for the content, accuracy, or legality of any third-party advertisements or websites linked within the Service. We reserve the right to modify the types and placement of advertisements within the App at our discretion. Where applicable, information regarding any available opt-out options for advertising will be provided within the App or these Terms. Any promotions offered by Fantasy+ will be subject to their own set of specific terms and conditions, that will be made available when the promotion is offered.
